Compliance and Owner Obligations for Apartment Buildings

Multifamily exterior work runs into two things at once: the obligations that attach to the sidewalk out front, and the rules that attach to working above a public way. Both land on the owner, not the contractor.

  • Sidewalk upkeep – Administrative Code 16-118 requires owners, lessees and occupants to keep the abutting sidewalk, flagging and curbstone free of obstruction and refuse, including the roadway extending a foot and a half from the curb. DSNY’s schedule sets dirty sidewalk at 100 dollars and sweeping debris into the street at 75, 250 and 350 dollars for successive offenses.
  • Owner liability for the sidewalk – Administrative Code 7-210 makes owners of abutting property liable for injury caused by failure to maintain the sidewalk in a reasonably safe condition, expressly including the negligent failure to remove snow, ice, dirt or other material. The exemption covers owner-occupied one, two and three family homes used exclusively as residences. Apartment buildings are not exempt.
  • FISP and facade cycles – The Facade Inspection Safety Program under Administrative Code 28-302 requires buildings taller than six stories to be inspected every five years by a Qualified Exterior Wall Inspector. Cycle 10 runs 2025 to 2029, with sub-cycle A closing February 2027, B February 2028 and C February 2029. We schedule cleaning around your inspection and repair sequence.
  • What we do not do on FISP – We are not a filing party. FISP reports are filed by a Qualified Exterior Wall Inspector, who is a Registered Design Professional. Any contractor offering to handle your Local Law 11 compliance is describing a role they cannot hold.
  • Working above residents – Suspended scaffold work in New York City requires crews to hold the DOB 16-Hour Suspended Scaffold User certificate, with a licensed rigger, licensed sign hanger or designated foreman supervising on site, and OSHA requires both a personal fall arrest system and a guardrail system on adjustable suspension scaffolds.
