Restaurants carry more exterior compliance exposure than any other property type we serve, because grease, refuse, pests and a licensed dining setup all sit within twenty feet of each other on the sidewalk. Here is what actually applies.

  • Grease rules – Title 15 RCNY 19-11 requires non-residential grease generators to correctly install, operate and maintain properly sized grease interceptors, installed by a New York City Licensed Master Plumber, with accumulated grease kept under 25 percent of liquid depth and enzyme, microbial and chemical additives prohibited. DEP puts the maximum penalty at 10,000 dollars per day per violation.
  • Grease-laden wash water – Title 15 RCNY 19-03 excludes fats, oils and grease from the combined and sanitary sewers and caps non-polar material at 50 mg/L, and 19-02 permits only stormwater or allowable runoff into a storm sewer. Hosing a greasy sidewalk toward the curb is the exposure, which is why we capture and recover instead.
  • Outdoor dining cleanliness – Under the Dining Out NYC rules at 34 RCNY 5-10(a)(1), sidewalk and roadway cafes must be kept clean, well maintained and clear of trash, debris, graffiti, vermin, food scraps and unsanitary conditions, and a roadway cafe licensee must also keep clean the roadway extending a foot and a half beyond the cafe on all sides.
  • Outdoor dining enforcement – First violations generally draw a 30-day corrective action request, with penalties running 200 dollars for a first offense and 500 dollars for subsequent ones, and repeated violations can lead to suspension or revocation of the license. Licensees also certify a contract with a licensed pest control professional under 34 RCNY 5-04(c)(5).
  • Health Code context – Health Code Article 81 requires food service establishments to be kept free of rodents, insects and other pests under 81.23, to store and dispose of garbage so food and food-contact surfaces are protected under 81.24, and to keep non-food-contact surfaces free of accumulated dust, dirt, food residue, grease and debris under 81.27.   • What we will not claim – We will not tell you a dirty sidewalk lowers your letter grade. We could not verify that the exterior face or the public sidewalk is a scored inspection item, and neither can the contractors who sell it. What is documented is the pest, refuse and grease language above, and the fact that food residue outside the door feeds the pest problem that is scored.
  • Sidewalk obligations – Administrative Code 16-118 requires the abutting sidewalk and the first eighteen inches of roadway to be kept free of refuse and penalizes flushing debris into the street. Debris is swept and bagged before washing rather than after.
  • Scheduling – Service runs after close or before opening so no cleaning happens around service, seating or deliveries, and Administrative Code 24-218’s prohibition on unreasonable noise is respected on blocks with residential floors above.
  • Insurance and documentation – Certificates of insurance naming your entity are issued before the first visit. New York employers carry workers’ compensation under Workers’ Compensation Law sections 2 and 3 and disability and paid family leave coverage under section 202.
