Storefront Compliance and Liability for Retail Properties

- Sidewalk upkeep and penalties – Administrative Code 16-118 requires owners, lessees, tenants and occupants to keep the abutting sidewalk, flagging and curbstone free of obstruction and refuse, including a foot and a half of roadway. DSNY sets dirty sidewalk at 100 dollars and sweeping debris into the street at 75, 250 and 350 dollars for successive offenses, with escalation for repeats at the same address within twelve months.
- Who is actually liable – Administrative Code 7-210 places liability for failure to maintain the abutting sidewalk on the owner of the real property, expressly including failure to remove dirt or other material. Leases often push the cleaning duty to the tenant, but the statutory liability sits with the owner, which is why landlords increasingly buy the service centrally.
- Accessible entries – Section 302.1 of the 2010 ADA Standards requires ground surfaces on an accessible route to be stable, firm and slip resistant. - Wash water containment – Title 15 RCNY 19-02 permits nothing but stormwater or allowable runoff into a City storm sewer or catch basin. Drains inside the work zone are matted and bermed before water is turned on, and wash water is vacuumed back for legal disposal.
- Trading hours – Service runs before opening or after close so the sidewalk is dry and passable during trade, and Administrative Code 24-218’s prohibition on unreasonable noise governs blocks with apartments above the retail.
- Insurance and documentation – Certificates of insurance naming your entity are issued before the first visit. New York employers carry workers’ compensation under Workers’ Compensation Law sections 2 and 3 and disability and paid family leave coverage under section 202.
